Suspect in attempted murder pleads no contest

HIAWATHA, Kan. — The attempted murder case against Robert Atlas is no longer headed for a jury trial.

At a hearing Friday in Brown County District Court, the Fairview man pleaded no contest to attempted murder in the second degree and three other charges as part of a plea deal reached with the prosecution.

A jury trial had been scheduled for October after Mr. Atlas, 34, pleaded not guilty to attempted first degree murder and six other charges in August.

He is accused in the December 2008 shooting of Emily Wichman at the Country View Apartments in Hiawatha.

As part of the plea agreement, County Attorney Kevin Hill filed an amended complaint with four charges that also included aggravated burglary and two counts of aggravated assault. Mr. Hill also agreed to dismiss a separate case against Mr. Atlas, involving a charged of felony criminal threat and misdemeanor domestic battery charges stemming from an alleged domestic dispute with Ms. Wichman in November 2008. A jury trial in that case also was set for October.

Sentencing for Mr. Atlas is scheduled for Nov. 23.

Mr. Hill said the maximum prison time Mr. Atlas faces across all counts is 24 years based on his criminal history.

Since last December’s shooting, those close to the case have described a turbulent on-again, off-again relationship between Mr. Atlas and Ms. Wichman.

Mr. Hill recapped what witnesses said happened that night. Ms. Wichman, then 21, was shot while at the apartment of acquaintances. After an argument over the phone and via text messages, an angry Mr. Atlas allegedly came to the apartment, kicked in the front door and pointed a handgun at people before fighting with Ms. Wichman and firing two shots at her. He was apprehended following a police chase in Hiawatha.

He remains incarcerated at the Brown County Jail.
